Terms of Service

These Terms of Service govern access to and use of Nimsora's website, AI Front Desk and related technology and automation services.

1. Acceptance of these terms

By accessing or using Nimsora's services, you agree to these Terms of Service and any additional terms agreed to in connection with a specific service.

If you are using Nimsora on behalf of a business or organization, you represent that you have authority to act on its behalf.

2. Nimsora services

Nimsora develops and provides technology and automation services for businesses. These services may include AI-powered communication, appointment workflows, lead capture, automated follow-up, integrations and related functionality.

The exact features available to a customer depend on the selected plan, configuration, integrations and any separate agreement between Nimsora and the customer.

3. AI Front Desk

AI Front Desk uses artificial intelligence and automated systems to interact with callers or users and perform configured tasks.

Artificial intelligence can occasionally misunderstand a request, produce an inaccurate response or behave differently from what a human operator would have done. Customers should consider these limitations when deciding which tasks the service is permitted to perform.

Nimsora may configure safeguards and workflow rules, but automated systems should not be treated as a substitute for professional judgment where professional judgment is required.

4. Customer responsibilities

Customers are responsible for providing accurate information, instructions, business rules and permissions needed to configure their services.

Customers are also responsible for:

  • Reviewing business information supplied to the AI Front Desk
  • Keeping appointment rules, opening hours and service information current
  • Maintaining appropriate access to connected business systems
  • Using Nimsora in accordance with applicable laws and regulations
  • Obtaining notices, permissions or consents required for their communications
  • Reviewing automated workflows before relying on them for important business processes

5. Acceptable use

Nimsora services must not be used for unlawful, fraudulent, abusive or deceptive activity.

Customers must not knowingly use the services to:

  • Impersonate another person or organization without authorization
  • Commit fraud or facilitate unlawful activity
  • Harass, threaten or intentionally deceive people
  • Distribute malicious software or interfere with computer systems
  • Attempt to gain unauthorized access to Nimsora or third-party systems
  • Violate applicable privacy, communications or consumer-protection laws

We may restrict or suspend access when reasonably necessary to address abuse, security risks or unlawful use.

6. Plans, fees and usage

Paid services may include recurring subscription fees, one-time setup or onboarding fees, usage allowances and additional usage charges. Applicable pricing will be communicated before service activation.

Where a plan includes a monthly usage allowance, usage above that allowance may result in additional charges at the applicable rate.

Unless otherwise agreed, fees for setup, configuration or work already performed are not refundable merely because a customer later decides not to continue using the service.

7. Third-party services

Nimsora relies on and may integrate with third-party technology providers. These may include cloud infrastructure, telecommunications, email, artificial intelligence, scheduling, automation and other business platforms.

Third-party services may experience outages, change their products or pricing, modify their APIs or discontinue functionality. Some aspects of Nimsora may therefore depend on systems outside our direct control.

Use of a third-party service may also be subject to that provider's terms and policies.

8. Google integrations

Where a customer authorizes access to Google services, Nimsora may use that access to perform functions requested by the customer, such as checking calendar availability, creating appointments or sending authorized communications.

Customers remain responsible for determining which accounts and permissions they choose to connect to Nimsora.

9. Service availability

We aim to provide reliable services, but we do not guarantee that every service will operate without interruption, delay or error.

Availability can be affected by maintenance, internet connectivity, telecommunications networks, third-party providers, software changes, security incidents and circumstances outside our reasonable control.

10. Changes to services

We may update, improve, replace or discontinue features as our technology and products develop.

Where a material change significantly affects a paid service, we will make reasonable efforts to communicate the change to affected customers.

11. Intellectual property

Nimsora and its associated software, designs, workflows, branding, documentation and technology remain the property of Nimsora or the applicable rights holder unless otherwise agreed in writing.

Customers retain ownership of their own business information and other content they provide to Nimsora.

12. Confidentiality

In providing services, each party may receive non-public information belonging to the other. Each party should use reasonable care to protect confidential information and use it only for appropriate business purposes connected with the service.

13. Suspension and termination

A customer may discontinue a service subject to any applicable subscription, billing or contractual terms.

Nimsora may suspend or terminate access where reasonably necessary because of non-payment, unlawful use, security risks, abuse, violation of these terms or circumstances that make continued service impractical or unsafe.

14. Disclaimer

Except where expressly agreed otherwise or required by law, Nimsora services are provided on an "as available" basis.

We do not guarantee that automated responses will always be accurate, that every call or enquiry will result in a successful outcome, or that the service will generate a particular amount of revenue, appointments or business.

15. Limitation of liability

To the extent permitted by applicable law, Nimsora will not be liable for indirect, incidental, special or consequential losses arising from the use of or inability to use the services.

Nothing in these terms excludes liability that cannot legally be excluded or limited.
